Terms of Service

Welcome to College Marketplace. These Terms of Service ("Terms") govern your access to and use of our website at mycollegemarketplace.com, our mobile applications, and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old and a currently enrolled student, faculty member, or staff member at a participating college or university to use the Platform.

If you are between 13 and 17 and enrolled at a participating school, you may use the Platform only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

You must verify your eligibility using a valid school-issued email address. You may not create an account using someone else's email address or misrepresent your school affiliation.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us promptly at support@mycollegemarketplace.com if you believe your account has been compromised.

2. Description of Service

College Marketplace provides an online venue that allows verified members of college communities to list, discover, buy, sell, and exchange goods and services with one another.

We are a venue only. College Marketplace is not a buyer, seller, broker, agent, auctioneer, escrow service, or party to any transaction between users. We do not take possession of, inspect, ship, or deliver any item listed on the Platform.

We do not process payments between users. All payments for items listed on the Platform are arranged and completed directly between the buyer and seller, outside of the Platform, using methods of their own choosing.

3. User Content

You are solely responsible for any listings, messages, images, descriptions, comments, reviews, and other content you post or transmit through the Platform ("User Content").

You represent and warrant that you own or have all necessary rights to your User Content, and that it does not violate these Terms, any applicable law, or the rights of any third party.

By posting User Content, you grant College Marketplace a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content for the purpose of operating, improving, and promoting the Platform. This license ends when you delete the content, except to the extent it has been shared with others who have not deleted it, or where we are required to retain it by law.

We do not claim ownership of your User Content.

We have no obligation to monitor User Content, but we reserve the right to review, remove, or restrict any content at our sole discretion, with or without notice.

4. Prohibited Items and Conduct

Prohibited Items

You may not list, offer, buy, sell, or promote:

  • Illegal drugs, controlled substances, or drug paraphernalia
  • Alcohol, tobacco, vaping products, or cannabis products
  • Firearms, ammunition, weapons, or explosives
  • Prescription medications or medical devices
  • Stolen property, or property you do not have the right to sell
  • Counterfeit, replica, or unauthorized goods
  • Recalled items
  • Live animals
  • Academic cheating services, completed assignments, exam materials, or other content that violates academic integrity policies
  • Pornographic, sexually explicit, or obscene material
  • Personal information or data belonging to others
  • Any item or service prohibited by applicable federal, state, or local law, or by the policies of the school community in which it is listed

Prohibited Conduct

You may not:

  • Post false, misleading, or fraudulent listings
  • Harass, threaten, stalk, defraud, or abuse other users
  • Impersonate any person or entity, or misrepresent your affiliation
  • Solicit users for purposes unrelated to the Platform, including spam or unsolicited commercial messaging
  • Attempt to move a transaction off-platform in order to defraud another user
  • Use bots, scrapers, or other automated means to access, collect data from, or interact with the Platform
  • Attempt to interfere with, compromise, or gain unauthorized access to the Platform or any user's account
  • Circumvent any content moderation, verification, or security measure
  • Use the Platform for any unlawful purpose

Housing Listings and Fair Housing

Listings in the Housing category are subject to federal, state, and local fair housing laws, including the Fair Housing Act.

You may not post any housing listing, statement, or advertisement that indicates a preference, limitation, or discrimination based on race, color, religion, sex, national origin, familial status, disability, or any other characteristic protected under applicable law.

We remove discriminatory housing listings and may suspend or terminate accounts that post them.

Ticket Listings

Listings in the Tickets category must comply with all applicable ticket resale laws, which vary by state and may restrict resale above face value, as well as with the terms and transfer policies of the issuing venue, event, or institution.

Many schools restrict or prohibit the transfer and resale of student tickets. You are responsible for confirming that your listing complies with your school's policies. We are not responsible for tickets that are invalidated, revoked, or refused entry.

5. Transactions Between Users

All transactions occur directly between users. College Marketplace:

  • Does not inspect, test, or authenticate any item
  • Does not guarantee the quality, safety, legality, or accuracy of any listing
  • Does not verify that a seller owns or has the right to sell an item
  • Does not guarantee that a buyer will pay or that a seller will deliver
  • Does not hold funds, process payments, or provide escrow
  • Does not provide refunds, returns, or dispute resolution for user-to-user transactions
  • Provides no warranty of any kind with respect to items or users

You assume all risks associated with transactions arranged through the Platform, including the risk of nonpayment, nondelivery, misrepresentation, defective or unsafe items, and loss.

Any dispute arising from a transaction is solely between the buyer and seller. You release College Marketplace from any claims, demands, and damages arising out of or connected with such disputes.

6. Safety and In-Person Meetings

The Platform facilitates in-person exchanges between users. You are solely responsible for your own safety.

We strongly recommend that you:

  • Meet in public, well-lit locations, preferably on campus
  • Meet during daylight hours where possible
  • Bring a friend
  • Tell someone where you are going and when you expect to return
  • Inspect items before paying
  • Trust your instincts and leave any situation that feels unsafe
  • Never share your home address, financial account details, or government identification

College Marketplace does not conduct background checks on users. Verification of a school email address confirms only that a user has access to that address. It is not a guarantee of identity, character, trustworthiness, or safety.

College Marketplace is not responsible for the actions, conduct, or safety of any user, whether online or in person.

If you feel unsafe or witness criminal activity, contact campus security or local law enforcement immediately.

7. Reporting and Moderation

The Platform includes tools to report listings, messages, and users, and to block other users.

We review reports and may remove content, restrict features, suspend accounts, or terminate accounts in response. We aim to act on reports of objectionable content promptly.

We do not tolerate abusive users or objectionable content. Accounts that engage in harassment, fraud, or repeated violations of these Terms may be removed without notice.

To report a violation, use the reporting feature in the app, or contact support@mycollegemarketplace.com.

8. Promoted and Featured Listings

We offer paid placements that increase the visibility of a listing ("Promoted Listings").

Purchases. Promoted Listings are purchased through the Apple App Store using in-app purchase. Apple processes the payment and Apple's terms govern the transaction. We do not receive or store your payment card information.

What you are buying. A Promoted Listing purchase buys increased placement or visibility for a stated period. It does not guarantee any number of views, messages, inquiries, or a sale.

Disclosure. Promoted Listings are labeled as such within the Platform.

Refunds. Purchases made through the Apple App Store are subject to Apple's refund policy, and refund requests must be made to Apple. We do not process refunds directly.

If we remove a Promoted Listing because it violates these Terms, no refund is provided and the remaining promotional period is forfeited. If we remove or fail to display a Promoted Listing for reasons attributable solely to us, contact us at support@mycollegemarketplace.com and we will make a reasonable accommodation.

Changes. We may change the pricing, features, or availability of Promoted Listings at any time. Changes will not affect a promotional period you have already purchased.

9. Account Suspension and Termination

We may suspend or terminate your account, remove your content, or restrict your access to the Platform at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, deceptive, or abusive activity
  • Conduct that harms or may harm other users, the Platform, or College Marketplace
  • Loss of eligibility, including no longer being affiliated with a participating school
  • Any reason, at our sole discretion

You may delete your account at any time through the app's Settings, or by contacting support@mycollegemarketplace.com.

Upon termination, the licenses you granted us in Section 3 survive to the extent necessary, and Sections 5, 10, 11, 12, 13, 14, and 16 survive.

10. Intellectual Property

The Platform, including its software, design, text, graphics, logos, and the "College Marketplace" name and branding, is owned by College Marketplace and protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Platform without our prior written permission.

Copyright Complaints

If you believe content on the Platform infringes your copyright, send a notice to support@mycollegemarketplace.com including:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the material claimed to be infringing and its location on the Platform
  4. Your contact information
  5. A statement that you have a good faith belief the use is not authorized
  6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act on the owner's behalf

We remove infringing material and terminate the accounts of repeat infringers.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied.

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We make no warranty that the Platform will be uninterrupted, secure, error-free, or available at any particular time, that defects will be corrected, or that the Platform is free of viruses or other harmful components.

We make no warranty regarding any item, listing, user, or transaction on the Platform.

12. Limitation of Liability

To the maximum extent permitted by law, College Marketplace and its owners, operators, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Platform.

This includes, without limitation, damages arising from:

  • Any transaction, interaction, or dispute with another user
  • Any in-person meeting arranged through the Platform
  • The conduct of any user, whether online or offline
  • Any content posted by users
  • Unauthorized access to your account or data

In no event shall our total aggregate liability exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless College Marketplace and its owners, operators, employees, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the Platform
  • Your User Content
  • Your violation of these Terms
  • Your violation of any law or the rights of any third party
  • Any transaction or interaction between you and another user

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of laws principles.

Informal resolution first. Before filing any claim, you agree to contact us at support@mycollegemarketplace.com and attempt to resolve the dispute informally for at least 30 days.

Venue. Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Marion County, Indiana, and you consent to the personal jurisdiction of those courts.

Class action waiver. To the extent permitted by law, you agree that any dispute will be brought in your individual capacity and not as a plaintiff or class member in any class or representative proceeding.

Nothing in this section prevents either party from seeking relief in small claims court.

15. Apple App Store

If you access the Platform through an application obtained from the Apple App Store, you acknowledge that:

  • These Terms are between you and College Marketplace, not Apple. Apple is not responsible for the application or its content.
  • Apple has no obligation to provide maintenance or support for the application.
  • If the application fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claim relating to the application, including product liability, legal or regulatory noncompliance, or consumer protection claims.
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim relating to the application.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. General

Changes to these Terms. We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, where appropriate, provide notice within the Platform. Your continued use after changes take effect constitutes acceptance.

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and College Marketplace regarding the Platform.
